Membership Agreement
- Parties
i. www.ipekevi.com(hereinafter referred to as "Ipekevi") headquarters is located in Bursa, Turkey (at).
ii. A member of Ipekevi (hereinafter referred to as "Member"). - The Subject of Agreement
The subject of this agreement states membership terms and conditions of shopping on Ipekevi. - Rights and Obligations of the Parties
i. IPEKEVI declares: the Member, must make sure personal and general information provided on IPEKEVI is truthful and that all damages given to IPEKEVI caused by any dishonesty will be compensated immediately.
The Member, cannot give their account password to third parties, the password solely belongs to the member himself/herself. IPEKEVI reserves the right to demand any compensation that may arise for claims and/or demands that may be used against IPEKEVI by third parties or competent authorities.
ii. The Member using IPEKEVI (website) has agreed in advance to not violate rules and (legal) regulations. Otherwise, it is the customer who will take sole responsibility for all legal and criminal actions that arise.
iii. The Member of IPEKEVI, cannot use the website in any manner that; violates public-order, is against public morals, harasses others or infringes on the intellectual and copyright of others for any illegal purpose. Also, the Member cannot use any sort of malware (spams, viruses, worms, Trojan horses or other malicious programs) that will prevent other members from using IPEKEVI.
iv. Personal opinions, expressions or reviews of Members, solely belong to them (Members), and have no connection or contact with IPEKEVI in any way. IPEKEVI has no liability for damages that the Member and third parties may experience due to opinions or expressions declared towards one another.
v. IPEKEVI will not be held responsible for unauthorized viewing and damages of Member data. The Member has agreed in advance to not claim compensation from IPEKEVI for any damage suffered by the use of the IPEKEVI website.
vi. The Member agrees not to access or use any other Member’s account or data without permission. Otherwise, it is the Member who will take sole responsibility for all legal and criminal actions that arise.
vii. The Member who violates one or more of the listed terms and conditions in the Membership Agreement, shall be personally and criminally liable for the violation. IPEKEVI will not be held accountable for the consequences of such violations. Also, due to the violation of law, IPEKEVI reserves the right to compensate for the Member’s non-compliance with IPEKEVI’s Membership Agreement.
viii. IPEKEVI always has the right to unilaterally delete the Member's membership, files, documents and information. The Member accepts this in advance and in this case, IPEKEVI holds no responsibility.
ix. The software and design of the website is exclusive to the ownership of IPEKEVI. Copyright and/or other intellectual property rights are protected by applicable laws and may not be used, acquired or modified by the Member. Other companies and products mentioned on this website are trademarks of their respective owners and protected by intellectual property rights.
x. IPEKEVI uses the Internet Protocol (IP) server in order to better improve and develop the website within the legislation framework. The server can collect information such as; the date and time the pages were accessed on the website.
xi. IPEKEVI can use Members personal information in order to improve their services, facilitate the use of the site and to work on specific preferences and interests of users. IPEKEVI reserves the right to keep a record of Members actions on the website.
xii. The Member accepts and acknowledges that: IPEKEVI and all affiliated companies are allowed to send; product and service promotions, advertisements, campaigns, surveys and other customer satisfaction applications.
xiii. The Member accepts and acknowledges that: IPEKEVI is able to collect, share and archive information such as; personal and shopping information and consumer behaviour information, (for the reasons above) with affiliated companies.
The Member accepts and acknowledges that: Even when the membership ends, IPEKEVI and affiliated companies are able to share and archive the collection of data, unless the Member reports the affirmation.
The Member accepts and acknowledges that: He/She will not be able to make a claim if he/she suffers any, financial, moral and positive or negative hardship due to the sharing, using or archiving of collections (as mentioned above) and that neither IPEKEVI nor (the) affiliated companies will hold any responsibility.
If the Member wishes to change their information sharing preferences, they can contact IPEKEVI’s customer service.
xiv. When/If IPEKEVI requires the Member's personal information, they may kindly explain to Members that it was out of necessity due to; a legal obligation(s), to comply with legislations or/and to protect the rights and property of IPEKEVI.
xv. IPEKEVI has taken precaution to ensure that their website is free of viruses and similar malwares. IPEKEVI recommends users to use an additional virus protection software in order to ensure the ultimate safety. The Member accepts and acknowledges that: It is the Member that will take sole responsibility for the consequences of errors that may occur in their software and operating system(s).
xvi. IPEKEVI reserves the right to: Change or delete the content or features of the website and delete user information and data registered on IPEKEVI at any time.
xvii. IPEKEVI may, modify, update or cancel the terms and conditions of the Membership Agreement at any time without prior notice. Any provision that has been amended, updated or removed, will be in service for all Members at the time of publication.
xviii. The Parties accept and declare that: In accordance with the HUMK (Code of Civil Procedure) Act 287, all computer records of IPEKEVI are sole and actual records and constitute a contract proof.
xix. The Member accepts and acknowledges that: In accordance with this Membership Agreement, IPEKEVI has the right to send informational e-mails and text messages to the Members registered e-mail address(es) and phone number(s).
4. Termination of Agreement
This Membership Agreement will remain in effect until it is cancelled by IPEKEVI or the Member. IPEKEVI may independently terminate the membership if the Member violates any provision of the Membership Agreement.
5. Conflict Resolution
BURSA Courts and Executive Offices are authorized for settlement of all disputes arising from this Membership Agreement.
6. Enforcement
The Member accepts and acknowledges that: Signing this Membership Agreement means that the Member has read and accepted all the terms and conditions of the Membership Agreement. This Agreement is concluded at the moment of the Member’s membership and mutually entered into force.
